Subject: Lies and theft on Ilena's web site

Let's look at the theft first.

In several places on the web site at humanticsfoundation.com
(apparently the web site of a non-profit organisation devoted to the
support of women suffering damage from breast implants) a graphic
image appears which shows the words "the rag-tag posse of snake-oil
vigilantes". This graphic was taken from a web site owned by me. No
request was made by the owner of the humanticsfoundation.com site for
permission to use this copyright material, and permission is
explicitly denied. Freedom of speech does not imply permission to
steal the intellectual property of others. If the image is not removed
from the humanticsfoundation.com web site within 24 hours of
publication of this notice then the only implication which can be
drawn is that Ilena Rosenthal is a thief. We already know that she has
no respect for the laws of defamation, so it will come as no surprise
if she continues to display stolen material on her site.

Now the lies.

The following words appear on the humanticsfoundation.com web site:

>Bowditch and his company, Gebesse removed malicious material on
>the Web after being forced to settle this case filed against them
>by ACN, the Australian Communications Network ... or have to
>continue to defend themselves in a losing battle.

>Here is the Order against Peter Bowditch and Gebesse Holdings
>(I've copied it below since it's buried beneath other attacks
>on his webpage.) Here is the link to what he is now prohibited
>from posting because it is "false and misleading."

Embedded in those words are two links to material supposedly
representing the results of a court action in which I was involved. A
link from the word "Order" might be expected to go to an order by a
court but in fact goes to a page on some quackery supporters web site.
Referring to it as an "Order" is an obvious case of misrepresentation.
Oops, did I say "misrepresentation"? I meant to say "lying".

The second link which is described as "what he is now prohibited
from posting" goes to a Google cache of an order made on the third day
of court proceedings and is the normal thing found in cases like
these, where any alleged offensive behaviour is restricted until the
Court has had time to hear the case. There is no reason why the link
needs to go to the Google copy, as the order can be seen in its
original form at
http://esearch.fedcourt.gov.au/Esearch?showDoc=24523728

Representing this as the final order of the Federal Court in the
matter demonstrates either complete ignorance of the legal process or,
more probably, contempt of the court in both the legal and everyday
sense of the word "contempt". That Ilena Rosenthal should be prepared
to lie about the outcome of a court case would come as no surprise to
anyone familiar with her statements and activities over the last few
years.

The final order by the court can be seen at
http://esearch.fedcourt.gov.au/Esearch?showDoc=24662304 and any
earlier order is irrelevant to the outcome of the case and merely
indicates a marker on the road to resolution.

So Ilena Rosenthal steals and lies. Is anybody surprised?
